CONSTRUCTION CONTRACTING PROCESSES

Yapan Construction Contracting Enterprises ere are the enterprises that undertake construction by undertaking the construction of a structure that will be owned by others. As it is understood from the definition, construction undertakings undertake construction activities on behalf of real and legal persons who wish to have construction. This relationship starts with a contract between the employer (natural or legal person to be built) and the construction undertaking. Before the contract to be made between the employer and the construction contracting firms on the construction of the building, there are some procedures that the employer should take:

Preparation of the project,
Determination of the cost of discovery,
Determination of pricing method,
Determination of the method of receiving bids,
The tender of the project
The tenderer shall submit an offer to the project. The tenders are evaluated by the employer and the contract is signed with the construction contracting entity which gives the most appropriate bid and construction starts.

1. Process of Construction Commitments: 1.1 Preparation of the Project: The first work to be done in the construction contract works is the preparation of the project for the construction to be performed. The project is prepared by the owner of the job, ie the person who will have the construction done, or has it prepared by experts. If the employer employs someone in charge of preparing a project, the project is prepared by this person. If the employer does not employ such a person, he or she will have the project prepared by experts in this field.

In order to tender the construction that is planned to be constructed:

Land provided
Ownership and expropriation procedures have been completed,
Zoning permits obtained,
The project must be prepared. Projects consist of several plans:
Site Plan: The dimensions of the land, the location of the structure, the environment (neighboring land, street, street, etc.) distance and road elevation are specified in the plans.
Floor Plan: Plans showing the dimensions of elements such as rooms and various sections and stairs, enlightenment space and chimneys.
Sections: The plan showing the details of the resulting image assuming that the structure to be constructed is cut vertically and horizontally.
Appearance Plans: These are the plans that give the view of the building to be built from all facades.
Installation Plans: These are the plans and drawings showing the locations of electrical, water, heating, ventilation, elevator and cooling systems.
Detailed Plans: These are the pictures drawn in order to specify the joint points of the various elements constituting the structure to be constructed.
The projects to be formed according to the course of construction using the above plans are as follows: Preliminary Projects (Preliminary Project): The first project to be prepared for construction is a draft project;
Soil surveys of the land,
Basic studies,
Situation plan,
Floor and roof plans,
It consists of a report in which the architectural appearance of the construction will take place. Final Projects: After the preliminary project of the structure is approved, all units are measured and detailed. Thus, the final project is prepared. In other words, the definite project is the project that was created by reviewing the preliminary project in terms of its technical characteristics. Application Projects: After the final projects are approved, the application project is prepared in accordance with the details showing the architectural elements, installation dimensions and other details. This project consists of sub-projects such as architectural, static and installation projects.

1.2. Estimating Cost of Estimation: After the project is prepared, the estimated cost of the construction to be constructed is determined. The total cost of the construction is determined by adding the profit of the undertaking undertaking that will make the construction to this cost. Determining the cost of the discovery as missing or more leads to various problems. Therefore, when determining the cost of the discovery, it is very important to accurately calculate the cost of construction. All expenses to be made in the determination of the cost of the discovery can be determined in detail, the unit price lists or minimum construction square meter unit prices can be used for the works in the projects. The discovery showing the cost of construction in pens is called the first discovery.

1.3. Determination of Pricing Method: Once the estimated cost of the construction to be built (cost of discovery) is determined, the pricing method to be used in the evaluation of the works to be performed by the contracting company (contractor company) must be determined. Since this pricing method to be determined will be included in the contract with the contracting entity that will win the tender, this method must be determined by the employers before the tender of the job. If the pricing method is not specified in the contract, then the provisions of the Code of Obligations shall apply. According to this; “The price is determined according to the value of what is done and the cost of the contractor, if it is not previously decided or determined by the means to be determined according to the value of the work”. Price determination methods are:

Unit price method
Cost + profit method
Lump sum method
